Chic Sketch – Terms of Service

Welcome to Chic Sketch! These Terms of Service (“Terms”) govern your use of our website, mobile applications, merchandise, fashion illustration services, and event activations (collectively, the “Services”), operated by Appetizer Mobile LLC (“Chic Sketch,” “we,” “our,” or “us”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use our Services.

1. Services Offered

Chic Sketch provides:

• Custom digital sketches created by professional illustrators.
• Options to add subjects (people or pets), backgrounds, time-lapse videos of the sketch creation, and priority delivery.
• Merchandise sales, including phone cases, frames, apparel, and other products featuring your sketch.
• Event activations: Chic Sketch activates at both physical and virtual events, offering live sketching services for attendees, branded experiences, and customized event integrations.

2. Eligibility

You must be at least 13 years old to use our Services. If you are under 18, you may only use our Services with the consent and supervision of a parent or guardian.

3. Orders & Payment

• All prices are in U.S. dollars unless otherwise stated.
• Payment is due in full at the time of order or booking.
• Orders for custom sketches are considered personalized digital goods and are non-refundable once an artist begins work.
• Merchandise orders may be subject to shipping costs, taxes, and customs depending on your location.
• Event bookings may require deposits or additional terms outlined in separate agreements.

4. Delivery

• Sketches: Standard delivery is typically within 72 business hours. Priority delivery is available for an additional fee. Timelines may vary during periods of high demand or unforeseen events.
• Merchandise: Delivery times vary by location, carrier, and shipping method. Chic Sketch is not responsible for delays caused by third-party shipping providers.
• Events: For both physical and virtual event activations, delivery of sketches may occur in real-time or within a set timeframe agreed upon before the event.

5. Revisions & Changes

• Each sketch order includes one free revision, provided the request is made within 24 hours of delivery.
• Additional revisions or requests made after 24 hours may require an additional fee or new order.
• Merchandise cannot be changed, canceled, or refunded once production has started.
• Event activations are subject to cancellation and rescheduling policies outlined in separate event agreements.

6. Returns & Refunds

• Digital Sketches: Non-refundable.
• Merchandise: All sales are final, except in cases of defective or incorrect items due to production issues. Customers must contact support@chicsketch.com within 5 calendar days of delivery for resolution.
• Events: Refunds or credits may be issued only in accordance with agreed-upon event contracts.

7. Permitted Use of Sketches

• Sketches are for personal, non-commercial use only.
• You may not remove copyright, watermark, or proprietary notices.
• You may not resell, reproduce, or use sketches for commercial purposes without our prior written consent.
• Merchandise & Distribution: Any sketch that is printed on merchandise and distributed—whether at events, online, or otherwise—must include the Chic Sketch logo in a clear and visible manner. Unauthorized removal or alteration of the Chic Sketch logo is strictly prohibited.

8. Submission Guidelines

When submitting photos for sketches, you agree to:

• Provide clear, non-blurry images.
• Submit no more than 12 subjects per order. Larger groups require special arrangements.
• Not submit photos containing nudity, offensive, vulgar, or illegal content.
• We reserve the right to reject photos that do not meet our criteria.

9. Intellectual Property

• All sketches remain the intellectual property of Chic Sketch and its illustrators.
• You are granted a personal license to use and share your sketch for non-commercial purposes, including on social media.
• Chic Sketch may use completed sketches and submitted photos in promotional materials, galleries, or marketing, unless you opt out by contacting support@chicsketch.com.
• Event sketches created during Chic Sketch activations may be used by Chic Sketch for promotional purposes unless otherwise agreed in writing.

10. Privacy & Data Use

Your use of our Services is also governed by our Privacy Policy. By using Chic Sketch, you consent to the collection and use of your data in accordance with that policy.

11. Mobile App Use

By downloading and using the Chic Sketch app (iOS/Android), you agree that Chic Sketch may send emails and notifications about your orders, services, events, and company updates.

12. Third-Party Links & Tools

We may provide access to third-party tools and links. Chic Sketch is not responsible for third-party content, websites, or transactions. Use of third-party services is at your own risk.

13. Disclaimer of Warranties

Our Services and products are provided “as is” and “as available.” We do not guarantee uninterrupted or error-free service, or that products will meet your expectations.

14. Limitation of Liability

To the maximum extent permitted by law, Chic Sketch and Appetizer Mobile LLC are not liable for indirect, incidental, or consequential damages, including lost profits, data, or business opportunities.

15. Indemnification

You agree to indemnify and hold harmless Chic Sketch, Appetizer Mobile LLC, and affiliates from any claims, damages, or liabilities arising from your use of our Services or violation of these Terms.

16. Dispute Resolution

Disputes will first be attempted to be resolved informally. If unresolved, disputes shall be settled by binding arbitration under the rules of the American Arbitration Association. Class actions and jury trials are waived to the fullest extent permitted by law.

17. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.

18. Changes to Terms

We may update these Terms at any time. Updates will be posted on our website with the new Effective Date. Continued use of our Services indicates acceptance of revised Terms.
